Terms of Service

Short version: ParkemTrey provides trading education and tools, not financial advice. Trading is risky and results aren't guaranteed. What you buy is for your personal use only, so don't share or resell it.

1. Agreement

These Terms of Service ("Terms") apply to the ParkemTrey website, mentorship, Discord community, TradingView indicators and any other products or services we offer (together, the "Services"). "ParkemTrey," "we" and "us" refer to the operator of the Services. By using the website or purchasing any product, you agree to these Terms. If you don't agree, don't use the Services.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to purchase or use the Services.

3. Educational purposes only, not financial advice

All content, including the mentorship, live sessions, Discord messages, indicators, videos and posts, is provided for educational and informational purposes only. Nothing we provide is financial, investment, legal or tax advice, or a recommendation to buy or sell any security, futures contract or other instrument. We are not registered investment advisors, broker-dealers or commodity trading advisors. You are solely responsible for your own trading decisions.

4. Risk disclosure

Trading futures, forex and other leveraged products involves substantial risk of loss and is not suitable for everyone. You can lose some or all of your money, and in some cases more than your initial investment. Past performance, including student results, testimonials and example trades, is not indicative of future results. Testimonials reflect individual experiences and are not typical.

Hypothetical performance: hypothetical or simulated results have inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading. No representation is made that any account will or is likely to achieve profits or losses similar to those shown.

5. Purchases and payment

Products are sold as one-time purchases at the prices shown at checkout. Checkout and payment processing are handled by Whop and are also subject to Whop's terms. All sales are governed by our Refund Policy.

6. Your license

When you purchase a product, you receive a personal, non-exclusive, non-transferable license to use it for your own trading education. You may not:

share, resell, sublicense or give away access to the mentorship, Discord, indicators or course content;
record, copy, screenshot for redistribution, or republish lessons, live sessions or private Discord content;
copy, decompile, reverse engineer or recreate the indicators or their logic;
share your account or indicator access with anyone else.

All content, indicators, names and branding remain the property of ParkemTrey.

7. Community rules

To keep the Discord a helpful place, you agree not to harass, threaten or spam other members, promote other paid groups or services without permission, post illegal content, or impersonate staff. We may mute, remove or ban members who break these rules or these Terms, and may revoke access to products without a refund when content is shared or resold.

8. Indicators and third-party platforms

The indicators run on TradingView. We don't control TradingView, Whop, Discord, prop firms, brokers or other third-party platforms, and we are not responsible for their availability, rule changes, outages or decisions, including evaluation results or payout decisions made by prop firms. Indicators are analysis tools; they do not guarantee accurate signals or profitable trades. Features and versions may change over time.

9. Affiliate links

Some links on the website, including partner prop-firm and tool links and discount codes, are affiliate links. We may earn a commission if you sign up or purchase through them, at no extra cost to you. Your relationship with those partners is governed by their own terms.

10. Disclaimer of warranties

The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee any trading result, income or outcome.

11. Limitation of liability

To the fullest extent permitted by law, ParkemTrey and its team, moderators and partners will not be liable for any trading losses, lost profits, or indirect, incidental, special or consequential damages arising from your use of the Services. Our total liability for any claim is limited to the amount you paid for the product the claim relates to.

12. Indemnification

You agree to indemnify and hold ParkemTrey harmless from any claims, losses or expenses arising from your use of the Services, your trading activity, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the United States and of the state in which the seller resides, without regard to conflict-of-law rules.

14. Changes

We may update these Terms from time to time. The updated version takes effect when posted on this page. Continuing to use the Services after an update means you accept the new Terms.
